Tax recovery with AI: what it can find and what it cannot
The short answer
AI can read invoices, tax rules and regulatory changes faster than a team can, and point to where a company may be paying more tax than it should or missing a benefit. What it cannot do is replace the professional who decides. The value is in the evidence and the legal basis it brings, not in the decision.
Why tax is a good place for AI
Tax combines three things AI handles well when it is engineered properly: large volumes of documents, explicit rules, and a body of law that changes often. In Brazil in particular, the rules change constantly and the volume of invoices is high, so manual review always leaves money behind.
What it can actually find
- Classification divergences: the same product classified differently across invoices, which can mean tax paid at the wrong rate.
- Regime questions: whether the company's tax regime still fits its operation.
- Opportunities with legal basis: credits or benefits the company may be entitled to, with the norm cited.
- Regulatory changes: new rules from official sources that affect the company, as they are published.
What it cannot do
It does not replace the accountant, the auditor or the tax lawyer. It does not guarantee that every opportunity will be accepted. And a tool that lists opportunities without the norm and the evidence behind each one is creating work, not removing it.
How to evaluate a tax intelligence tool
Ask for three things. First, every finding must come with the legal basis and the document that supports it. Second, the tool must separate what is a deterministic calculation from what is an AI interpretation. Third, there must be a professional review step before anything is filed. If any of the three is missing, the risk falls on you.
How a finding should look
A useful finding is not "possible credit of X". It reads like a short dossier: the invoices or records involved, the rule or norm that applies, the calculation and its assumptions, what is deterministic and what is interpretation, and the risk if the interpretation is challenged. The professional should be able to accept or reject it in minutes, not rebuild it from scratch.
Questions to ask before using any tool
- Where does the legal base come from, and how often is it updated?
- Does every finding cite the specific norm and the source document?
- Which calculations are deterministic, and which depend on the model?
- Where is the data stored, and is it used to train anyone's model?
- Who signs off before anything is filed or offset?
- What happens when the law changes after a finding was made?
A tool that answers these clearly reduces risk. A tool that answers with a percentage of potential recovery is selling a number, not evidence.
Where TributoX fits
TributoX is our own tax intelligence product, built on these principles: a legal knowledge base searched with the source, monitoring of new norms from official sources, and an opportunity engine that combines rules, deterministic calculation and AI with a verifier. It runs in production; you can see it at tributoxai.com.
